International Court of Justice will resume hearing in the case of Indian Spy Kulbhushan Jhadav at the Hague on Monday (today).
Attorney General for Pakistan Anwar Mansoor is leading Pakistani delegation whereas Director General South Asia Dr Mohammad Faisal would lead the Foreign Office. English Queen’s Counsel Khawar Qureshi will make submissions on behalf of Pakistan whereas Harish Salve will represent New Delhi before the ICJ in the matter.
Earlier, Islamabad has produced evidence before the ICJ, extracted from Commander Jadhav during the investigation. After the trial, he was awarded death sentence on April 10, 2017 over fomenting terrorism in Pakistan. Pakistan submitted that it would be incompatible with international law for someone sent as a spy/terrorist by a State to be afforded access to officials of that State, as India claimed.
During the course of proceeding on Monday, India and Pakistan will deliver arguments during the first round of oral argument from Monday 18 February to Tuesday 19 February 2019 whereas second round of oral arguments will commence on February 20 to 21 whereas both the parties of the case will deliver arguments to substantiate their claim.
It is pertinent to mention that in response to New Dehli’s plea, the ICJ had stayed execution in the matter till final adjudication of the case. While delivering its order in the matter on May 18, 2017, the ICJ said, “For these reasons, THE COURT, Unanimously, Indicates the following provisional measures: Pakistan shall take all measures at its disposal to ensure that Jadhav is not executed pending the final decision in these proceedings and shall inform the Court of all the measures taken in implementation of the present Order. Unanimously, Decides that, until the Court has given its final decision, it shall remain seized of the matters which form the subject-matter of this Order.”
